1. Interpretation and Definitions

1.2 Definitions
Account refers to a unique account created by You to access and use the Application or certain parts of it. Your Account may include personal information, preferences, and usage data, and is used to authenticate Your identity and provide access to services, features, or content available through the Application, whether accessed via a mobile app or the web platform.
Application refers to the web-based and/or mobile platform provided by Citizen Remote, accessible via download from an Application Store or through the website www.citizenremote.com.
Country – Refers to Delaware, United States (the Company’s registered location).
Company (“We,” “Us,” or “Our”) – Refers to Citizen Remote.
Content – Any text, images, or other information that You post, upload, link to, or make available through the Service.
Feedback – Any suggestions, ideas, or improvements You share about our Service.

All immigration services are subject to the independent terms and conditions of the subcontracted specialists. Citizen Remote is not responsible for the actions, advice, or decisions of these third-party providers but ensures that they meet professional standards.
3.1. Service Scope and Limitations
Citizen Remote offers services related to immigration, tax advisory, and digital nomad resources. While the platform provides general informational content on these topics via its website, such content is for informational purposes only and should not be considered legal, financial, or tax advice. Users should consult with qualified professionals when making decisions based on this information.
In addition, Citizen Remote may facilitate access to professional advice or services through its network of vetted service providers. However, Citizen Remote does not guarantee the approval of visas, tax benefits, or other legal outcomes, as these are subject to the discretion of government authorities and other external factors beyond Citizen Remote’s control.
4. User Responsibilities
Users agree to:
Provide accurate, up-to-date, and complete information when using Citizen Remote’s services.
Maintain the confidentiality of their accounts and credentials.
Use the services in compliance with all applicable laws and these Terms.
Not engage in fraudulent, misleading, or illegal activities through the platform.
Failure to adhere to these responsibilities may result in the suspension or termination of services without a refund.
5. Placing Orders for Services
3.1 By placing an Order, You confirm that You are legally capable of entering into binding contracts.

4.2 You confirm that: (i) You have the legal right to use any payment method provided, and (ii) All information You submit is true, accurate, and complete.

7. Order Cancellation

We may refuse or cancel Your Order at any time for reasons including, but not limited to:
Service unavailability
Errors in pricing or description
Errors in Your Order
Suspected fraud, unauthorized, or illegal transactions
7.2 Your Right to Cancel

Cancellation rights do not apply to:
Personalized or customized services (e.g., coaching or consulting)
Services that cannot be returned (e.g., digital downloads, one-time consultations)
Time-sensitive services (e.g., event planning, expiring offers)
Services affecting health or hygiene once unsealed (e.g., wellness programs)
Services inseparably combined with others (e.g., bundled packages)
Services that have already begun with Your consent (e.g., scheduled sessions, subscriptions)
8. Availability, Errors, and Inaccuracies

All payments are subject to validation and authorization by Your payment provider. If authorization is declined, We are not responsible for delays or non-delivery of Your Order.

You are responsible for any Content You post on the Service, ensuring its legality, reliability, and appropriateness.
By posting Content, You grant Us a license to use, modify, display, and distribute it. You retain ownership but allow Us and other users to access and use it under these Terms.
You warrant that:

Illegal, offensive, or discriminatory.
Spam, unauthorized advertising, or gambling-related.

False, misleading, or impersonating others.
We reserve the right to remove or modify any Content that violates these rules and to limit or revoke access to the Service if necessary.
12.3 Content Backups
While We perform regular backups, We do not guarantee that all data will be preserved without loss or corruption. You are responsible for maintaining separate copies of Your Content.

13. Copyright Policy
13.1 Intellectual Property Infringement
We respect copyright laws and respond to claims of copyright infringement.

A description of the copyrighted work.
The location (URL) of the infringing content.
Your contact details (name, address, phone, email).
A statement that you believe the use is unauthorized.
A declaration under penalty of perjury that your claim is accurate.
Your physical or electronic signature.
False claims may result in legal consequences, including liability for damages.
13.2 DMCA Notice & Procedure
Under the Digital Millennium Copyright Act (DMCA), copyright owners can submit infringement claims following 17 U.S.C. § 512(c)(3).
Send all notices to hello@citizenremote.com. We may remove or restrict access to the reported content at our discretion.
14. Refunds and Eligibility
14.1 General Refund Policy for Provider’s services
Eligibility for Refunds:
If you cancel before any work has started, you are eligible for a full refund.
If services have begun but are not fully completed, a partial refund may be issued at Citizen Remote’s discretion, based on the work completed.
No Refund for Unsuccessful Outcomes:Refunds will not be granted based on an unsuccessful outcome, as results depend on factors beyond Citizen Remote’s control.
Client Responsibilities & Forfeiture of Refunds:
If you fail to attend scheduled calls, provide necessary documentation, or follow Citizen Remote’s guidance, you forfeit your right to a refund.
Final Decision: All refund requests will be reviewed individually, and Citizen Remote’s decision will be final.
14.2 Refunds for Annual Subscriptions
You may request a refund for an annual subscription within 14 days of purchase, unless you have used premium features (e.g., posting content or engaging with exclusive services).
If you have engaged with premium features within the first 14 days, you are not eligible for a refund.
14.3 Refunds for One-Off Services
Refunds for one-time services are not available once the service has been used in any way.
14.4 Refunds for Lifetime Subscriptions
Lifetime subscriptions are non-refundable after thirty (30) days from the date of purchase. Within the initial 30-day period, refund requests may be considered in accordance with applicable law or the Company's refund policy. After this period, all lifetime subscription fees are deemed final and non-refundable.
15. Third-Party Services:
Certain services available through the Citizen Remote platform are managed by third-party partners and are not part of Citizen Remote’s internal service offerings.Accordingly, refund requests related to such third-party services must be directed to and handled by the respective third-party provider, in accordance with their refund policies.
16. Feedback By providing feedback, you assign all related rights to the Company. If assignment is ineffective, you grant the Company a non-exclusive, perpetual, irrevocable, royalty-free license to use, modify, and distribute the feedback.
17. Termination We may suspend or terminate your access immediately, without notice, if you breach these Terms. Upon termination, your right to use the Service ceases.
18. Limitation of Liability Our total liability is limited to the amount you paid through the Service or $100 if you made no purchases. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions may not allow certain limitations, so they may not apply to you.
19. Disclaimer The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free operation, accuracy of information, or virus-free content. Some jurisdictions do not allow certain exclusions, so these may not fully apply to you.
20. Governing LawThese Terms are governed by the laws of the Country, excluding conflict of law rules. Other local, state, or international laws may apply.
21. Dispute ResolutionAny disputes arising out of or in connection with these Terms of Use shall first be resolved amicably through good-faith negotiation between the Parties. If no resolution is reached through negotiation, the dispute shall be referred to mediation, to be conducted in accordance with the laws of the State of Delaware.
If mediation is unsuccessful the matter shall be submitted to the exclusive jurisdiction of the courts of Delaware.
22. EU Consumers If you are a resident of the EU, you are entitled to the mandatory consumer protections of your country.
23. U.S. Legal Compliance You confirm that you are not in a country subject to a U.S. embargo or designated as supporting terrorism and that you are not on any U.S. restricted party list.
24. Severability & Waiver If any provision of these Terms is found unenforceable, it will be modified to fulfill its purpose as closely as possible under the law, while the rest remain in effect. Failure to enforce any right does not waive future enforcement of that right.
25. Translation If these Terms are translated, the English version will prevail in case of dispute.
26. Changes to Terms We may update these Terms at our discretion. If changes are significant, we will provide at least 30 days’ notice. Continued use of the Service after updates take effect constitutes acceptance of the new Terms. If you disagree, stop using the Service.
